Acacia MailGuard – Terms of Service

Welcome to Acacia MailGuard (“Acacia MailGuard,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our services, including but not limited to package pickup, temporary storage, secure handling, delivery notifications, and related offerings (“Services”).
By enrolling in, accessing, or using our Services, you agree to be bound by these Terms.
If you do not agree with these Terms, do not use our Services.


1. Service Overview

Acacia MailGuard provides a secure pickup and holding service designed to help protect your packages from theft. Our offering includes:
• Package pickup from customer-confirmed delivery locations
• Temporary secure storage until customer delivery
• Delivery-time notifications (if applicable)


2. No Guarantee of 100% Theft Prevention

While Acacia MailGuard significantly reduces the likelihood of package theft, we do not guarantee 100% theft prevention.
You acknowledge and agree that:
• Theft, loss, or interference may still occur outside of our control
• Our Services reduce risk but do not eliminate it


3. Customer Responsibilities

To use our Services, you agree to:

a. Provide Accurate Tracking Information

You must provide accurate and complete tracking numbers for all packages intended for pickup.
• If you fail to provide an accurate tracking number, Acacia MailGuard is not liable if that package is stolen.

b. Ensure Delivery Drivers Can Release Packages

You are responsible for:
• Ensuring your address allows safe pickup
• Ensuring no special restrictions exist preventing our access

c. Receive Packages Promptly

Customers must be available to receive their packages within the timeframe designated in their service plan.
Storage beyond the allotted period may incur fees (see Section 15).


4. Liability for Loss or Damage

Acacia MailGuard takes reasonable precautions to protect your items. However, our liability is limited.

a. Damage While in Our Possession

If an item is proven to be damaged while in Acacia MailGuard’s possession:
• We will refund up to $100 per package, please allow 7 - 10 business days.
• Damage must be supported with evidence such as photos, video, delivery condition, and an incident report.
• Package determined value must be accompanied by receipts showing dates and order numbers.

b. Loss Caused by Inaccurate Customer Information

We are not responsible for:
• Losses resulting from incorrect tracking numbers
• Items we were not notified about
• Items delivered to the wrong address
• Packages stolen within 30 minutes of our arrive for pickup

c. Items Handled Without Prior Registration

Any unregistered or unknown package is handled at the customer’s own risk.


5. Package Restrictions

Customers agree not to use the service for prohibited items including, but not limited to:
• Weapons or ammunition
• Illegal substances
• Perishable goods requiring refrigeration
• Cash or negotiable instruments
• Hazardous materials
• Fragile items improperly packaged
• items over $399

Acacia MailGuard may refuse pickup or storage of any package deemed unsafe or non-compliant.


6. Service Availability

Service availability may vary based on:
• Geographic coverage
• Weather and road conditions
• Staffing and operational limits
• High-volume seasons

Acacia MailGuard reserves the right to pause or adjust services without prior notice when necessary.


7. Customer Conduct

Customers agree not to:
• Harass staff
• Abuse service privileges
• Attempt to bypass pickup instructions
• Engage in any misuse of the service

Violation of these rules may result in service suspension.


8. Fees and Payments

All fees must be paid according to the pricing plan selected.
Acacia MailGuard may update pricing with notice.

Late retrieval fees, storage fees, or non-standard requests may incur additional costs.


9. Termination

Acacia MailGuard reserves the right to suspend or terminate service for:
• Fraudulent activity
• Abuse of services
• Repeated false claims
• Non-payment

You may cancel service at any time. No prorated refunds will be given for unused days.


10. Limitation of Liability

To the fullest extent permitted by law:
• Acacia MailGuard is not liable for any indirect, incidental, punitive, or consequential damages.
• Total liability for any claim related to our Services is limited to the amount you paid for the service or $100 per proven damaged package, whichever is less.


11. Indemnification

You agree to hold harmless and indemnify Acacia MailGuard, its staff, and partners from any claims or damages arising from:
• Misuse of the Service
• Providing incorrect information
• Violations of these Terms
• Your failure to comply with laws or carrier regulations


12. Changes to Terms

We may update these Terms at any time. Continued use of our Services constitutes acceptance of the updated Terms.


13. Governing Law

These Terms are governed by the laws of the State of Illinois.


14. Acceptance of Terms

By using Acacia MailGuard’s Services, you acknowledge that you have read, understood, and agree to these Terms of Service.


15. Storage Time Limits & Authorization to Charge Payment Method on File

By using Acacia MailGuard Services, you agree to the following:

a. Storage Time Limits

Each service plan includes a designated amount of 24 hours of free storage time for held packages.
Once that time expires, the package enters extended storage, which may incur additional fees.

b. Authorization to Charge

You authorize Acacia MailGuard to automatically charge the payment method on file for any extended storage fees if your package remains unclaimed beyond the allotted time.

c. Advance Notifications

Before any charge is processed:
• We will send reminders as the storage deadline approaches
• We will send a final notification prior to charging your card

d. Requesting an Extension

Customers who need additional time must:
• Notify Acacia MailGuard at least 12 hours before the storage deadline  via text message or email
• Receive confirmation of approval for the extension

Failure to request an extension within the required timeframe may result in automatic extended-storage charges.

e. Unclaimed Packages

Packages left unclaimed beyond the maximum storage period may be subject to:
• Additional daily storage fees of $100/day up to 3 days maximum
• Temporary service suspension
• Package redelivery after reasonable attempts to contact the customer
